Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to create an account and use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@runnershighapp.com if you suspect unauthorized use of your account.

3. User Responsibilities

When using the App, you agree to:

• Provide accurate and current information when creating your account;
• Use the App in a manner consistent with these Terms and all applicable laws;
• Exercise your own judgment and caution regarding your personal safety and physical limits while running, including with respect to traffic, terrain, weather, and surroundings;
• Respect other users when using social features such as friend groups, challenges, and the activity feed;
• Keep your device and app software reasonably up to date to ensure proper functionality.

Health and fitness disclaimer: RunnersHigh is a fitness tracking and motivation tool, not a medical device, and does not provide medical advice. Consult a physician before beginning any new exercise program, especially if you have a pre-existing health condition. You assume all risk associated with physical activity performed in connection with your use of the App.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful, harmful, or fraudulent purpose;
• Harass, threaten, impersonate, or abuse other users;
• Upload content that is defamatory, obscene, infringing, or otherwise objectionable;
• Attempt to falsify run data, GPS location, or progression metrics through unauthorized means, or otherwise manipulate the App's gamification systems;
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
• Interfere with or disrupt the App's infrastructure, security, or other users' experience;
• Use automated systems (bots, scrapers) to access the App without our prior written consent.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use section.

5. User Content

You retain ownership of content you submit to the App (such as profile photos, messages, and activity posts). By submitting content, you grant Pangea Tech LLC a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely for the purpose of operating and improving the App. You are solely responsible for the content you post and confirm you have the right to share it.

6. Intellectual Property

The App, including its design, features, graphics, logos, the RunnersHigh name and mascot, and underlying software, is owned by Pangea Tech LLC and its licensors and is protected by intellectual property laws. Except for the limited license to use the App for its intended personal purpose, no rights are granted to you in our intellectual property.

7. Third-Party Services

The App may link to or integrate with third-party services (for example, sign-in providers or platform health integrations). We are not responsible for the content, policies, or practices of any third-party service, and your use of those services is governed by their own terms.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GPS TRACKING, DISTANCE, PACE, OR OTHER METRICS WILL BE ACCURATE AT ALL TIMES. YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN SAFETY WHILE USING THE APP DURING PHYSICAL ACTIVITY.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PANGEA TECH LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING ANY INJURY SUSTAINED WHILE RUNNING OR EXERCISING. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Pangea Tech LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the App.

11. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if you violate these Terms or if we discontinue the App, with notice where reasonably practicable.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles, except where superseded by applicable federal law or mandatory consumer protection laws of your jurisdiction. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas, unless otherwise required by applicable law.
